Terms & Conditions
1. General
1.1. These General Terms and Conditions apply to every offer from Fish N Tips and to every distance contract concluded between Fish N Tips (“Seller”) and the consumer (“Buyer”).
1.2. By placing an order via the Fish N Tips website, the Buyer agrees to these General Terms and Conditions.
1.3. Fish N Tips sources products from international suppliers and offers them to customers in the Netherlands.
1.4. Deviations from these terms are only valid if confirmed in writing by Fish N Tips.
2. Products
2.1. Fish N Tips sells fishing equipment, including but not limited to rods, reels, and lures.
2.2. All products offered are non-perishable.
2.3. Product descriptions, specifications, and images are provided as accurately as possible, but minor variations cannot always be avoided and do not entitle the Buyer to compensation or cancellation.
2.4. Warranty provisions will be applied if and insofar as offered by the manufacturer or supplier.
3. Orders & Payments
3.1. Orders are placed exclusively via the website.
3.2. Payment must be made in full before order processing.
3.3. Accepted payment methods include iDEAL, PayPal, and major credit cards.
3.4. Once an order is placed, it cannot be cancelled or changed.
4. Shipping & Delivery
4.1. Products are shipped from the Netherlands.
4.2. Delivery times depend on availability and courier performance. Indicative delivery estimates will be provided during checkout but are not guaranteed.
4.3. Fish N Tips is not liable for delays caused by customs inspections, courier issues, supplier backlogs, or other circumstances beyond its control.
4.4. Shipping costs are charged to the Buyer and will be displayed during checkout.
4.5. The courier is responsible for packages lost or damaged in transit. Fish N Tips will assist in filing claims but is not liable for courier errors.
5. Returns & Refunds
5.1. In accordance with EU consumer law, Buyers may return products within 14 days of receipt (“reflection period”) without giving reasons.
5.2. Returned products must be unused, complete, and in their original packaging.
5.3. The Buyer bears the direct costs of returning the goods.
5.4. Refunds will be processed within 15 business days of receipt and inspection of returned goods.
5.5. No exceptions to the reflection period apply, unless otherwise required by law.
6. Liability
6.1. The liability of Fish N Tips is limited to the purchase price of the product concerned.
6.2. Fish N Tips is not liable for indirect damages, including but not limited to loss of profit, missed opportunities, or consequential damages.
6.3. Fish N Tips is not liable for delivery delays caused by suppliers, customs, or couriers, including delays related to international shipping.
7. Privacy & Cookies
7.1. Fish N Tips processes personal data in accordance with the General Data Protection Regulation (GDPR). Customer data is used for order processing, customer communication, and—if consented—marketing purposes such as newsletters.
7.2. Fish N Tips uses cookies to improve website functionality and analyze user behavior.
7.3. Google Analytics and other tracking technologies (e.g., Meta Pixel) may be used. These services may store data outside the EU, but only in compliance with GDPR safeguards.
7.4. By using the website, the Buyer consents to the use of cookies and the processing of personal data as described in the Privacy Policy, which forms an integral part of these Terms and Conditions.
8. Applicable Law & Disputes
8.1. All agreements between Buyer and Seller are governed exclusively by Dutch law.
8.2. Disputes will be submitted to the competent court in Rotterdam, unless mandatory law prescribes otherwise.
9. Final Provisions
9.1. If any provision of these General Terms and Conditions is declared invalid, the remaining provisions shall remain in full force.
9.2. Fish N Tips reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on the website and apply to all subsequent orders.
